All of us are aware of the tremendous strain placed upon the NHS and on the clinicians who work within it. The needs of an ageing population, combined with reduced funding mean that our NHS Hospitals simply cannot cope. Government ministers and Hospital administrators admit that in many places the service is in crisis.

It’s not only Accident and Emergency Department waiting times that are behind target. The NHS simply cannot meet its own deadlines and criteria for the provision of many of its clinical services. Inevitably, where a service is under such strain, medical negligence will occur and patients will suffer either from undiagnosed and untreated conditions, or alternatively will have to wait too long for their treatment.

At The Claims Partnership, we do not seek to criticise the National Health Service for its failings, less still the efforts of the clinicians and specialists that work within it. However, we recognise and believe that where a medical mistake or delay has led a patient to experience significant unnecessary pain and suffering, then that patient is entitled to compensation.

With this statement comes the realisation and understanding that claims on behalf of NHS patients have to be paid for from NHS funds, which are insufficient to meet the clinical needs of the nation. It is not a moral dilemma that we dismiss lightly. Nevertheless, we believe it is a fundamental human right of a mistreated patient to receive compensation and so does the NHS. From its initiation in 1946, the National Health Service has recognised that there will be clinical errors on the part of its clinicians and where patients suffer an injury, they should be compensated for those errors.
